Agreement to Terms

By accessing or using The Cool Views platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Eligibility

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

User Accounts

Account Creation

To use certain features of our Service, you must create an account. You agree to:

• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or other reasons we deem necessary to protect our platform and users.

Guest Responsibilities

As a guest, you agree to:

• Provide accurate booking information
• Pay all applicable fees and charges
• Treat properties with respect and care
• Follow house rules established by hosts
• Leave properties in reasonable condition
• Communicate promptly with hosts
• Report any issues or damages immediately

Host Responsibilities

As a host, you agree to:

• Provide accurate property listings and descriptions
• Have the legal right to rent your property
• Comply with all applicable laws and regulations
• Maintain your property in a safe and habitable condition
• Honor confirmed bookings
• Respond to guest inquiries promptly
• Provide the amenities and services advertised
• Report income and pay applicable taxes

Bookings and Payments

Booking Process

When you book a property, you enter into a contract directly with the host. The Cool Views acts as a platform to facilitate these transactions but is not a party to the rental agreement.

Payment Processing

All payments are processed securely through Stripe. By making a booking, you authorize us to charge your payment method for:

• The rental amount
• Applicable service fees
• Cleaning fees (if applicable)
• Additional charges as agreed with the host

Host Payouts

Hosts receive payment after successful guest check-in, minus our service fee. Payouts are typically processed within 24-48 hours of check-in.

Cancellation Policy

Cancellation policies vary by property and are set by individual hosts. Review the cancellation policy carefully before booking. Our platform fee is non-refundable except in cases of host cancellation.

Prohibited Activities

You may not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Post false, misleading, or fraudulent content
• Harass, threaten, or harm other users
• Attempt to bypass our payment system
• Use automated systems to access our platform
• Collect user data without authorization
• Impersonate others or provide false information
• Engage in any activity that disrupts our Service

Intellectual Property

The Cool Views platform, including its design, features, text, graphics, logos, and software, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

By posting content on our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with operating our Service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not guarantee the accuracy or reliability of property listings, and we are not responsible for the condition, safety, or legality of properties listed on our platform.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COOL VIEWS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months prior to the event giving rise to the liability.

Indemnification

You agree to indemnify and hold harmless The Cool Views, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

• Your use of our Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your property listing or rental

Dispute Resolution

Any disputes arising from these Terms or your use of our Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court. You waive your right to participate in class actions or class arbitrations.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our platform and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
